1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and MyCigar ("Company," "we," "us," or "our") concerning your access to and use of the MyCigar mobile application and website (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility and Age Requirement

By using this Service, you represent and warrant that:

• You are at least 18 years of age (or the legal smoking age in your jurisdiction, whichever is higher)
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under applicable laws
• You will comply with all applicable local, state, national, and international laws

We reserve the right to request proof of age at any time and to terminate accounts that we believe belong to users who do not meet the age requirement.

3. Account Registration

To use certain features of the Service, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account

You may not use another person's account without their permission. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Prohibited Conduct

You agree NOT to:

• Use the Service if you are under the legal smoking age
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service or servers
• Use the Service for commercial purposes without authorization
• Scrape, harvest, or collect user information without consent
• Impersonate another person or entity
• Post false, misleading, or defamatory content
• Harass, threaten, or intimidate other users
• Use automated systems (bots) to access the Service
• Circumvent any security measures or access restrictions

6. User Content

You retain ownership of content you create and upload to the Service ("User Content"), including journal entries, photos, ratings, and reviews. By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and process your content as necessary to provide the Service.

You are solely responsible for your User Content. You represent that you have all rights necessary to upload and share your content, and that your content does not violate any third-party rights or applicable laws.

We reserve the right to remove User Content that violates these Terms or that we deem inappropriate, without prior notice.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by MyCigar and are protected by copyright, trademark, and other intellectual property laws. Our trademarks, logos, and service marks may not be used without our prior written consent.

Cigar brand names, logos, and product information displayed in the Service belong to their respective owners and are used for informational purposes only.

8. Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites. Your use of third-party services is at your own risk and subject to their terms of service.

9. AI-Powered Features

The Service includes AI-powered features such as cigar identification and humidor recommendations. These features are provided for informational purposes only and may not always be accurate. We do not guarantee the accuracy of AI-generated results, and you should verify important information independently.

10. Disclaimers

Health Disclaimer: MyCigar is a cigar journaling and tracking application. We do not promote or encourage tobacco use. Tobacco use is harmful to your health. If you choose to use tobacco products, you do so at your own risk.

You agree to indemnify, defend, and hold harmless MyCigar and its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time through the Settings page. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by other means such as email or in-app notification. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MyCigar operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of that jurisdiction.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyCigar regarding your use of the Service and supersede all prior agreements and understandings.
